Motorway Bypass Construction Dispute

Goal
Matthew was appointed to act on behalf of the defendant in a Motorway Bypass Construction Dispute. He was requested to review a claimant’s claim and entitlement for an Extension of Time.

Background
The project was at the construction stage and was delayed by late utility design on a particular chainage on the project’s route. The late utility design delayed the structure activities within the particular chainage. The claimant applied for an Extension of Time under the Irish Public Works Contract (PWC) and associated programme delay costs.

Evaluation
Matthew assessed contemporaneous project records and established a detailed analysis. It was established that no delay occurred on the project due to the defendant’s late utility design.
